Terms and Conditions for Gift Certificate Use and Purchase

By purchasing or using a gift certificate from Jamie Lucas Images, you agree to the following terms and conditions. These terms govern the use of the gift certificate and any related services provided by Jamie Lucas Images.

1. General Terms

Gift certificates for a photography session with Jamie Lucas Images are non-refundable. The recipient of a gift certificate is responsible for scheduling their session directly with Jamie Lucas by phone or email.

Payment must be received in full before photography or editing services are provided, such as gift certificates, session fees and print orders. If payment is made via cheque and the cheque is returned due to insufficient funds (NSF), a $50 fee will apply, and the cheque will not be re-deposited. A certified cheque or money order, including the NSF fee, must be sent to cover the returned cheque.

2. Split Tender Transactions

If the gift certificate balance is insufficient to cover the full cost of a session fee or print order, a "split tender transaction" may be processed, allowing you to pay part with the gift certificate and the remainder with another accepted payment method.

3. Gift Certificate Restrictions

• Non-Refundable: Gift certificates cannot be redeemed for cash and are non-refundable.

• Expiration Date: The gift certificate expires on the date indicated on the certificate.

• Lost or Stolen Certificates: You agree to take all reasonable precautions to protect your gift certificate. If the gift certificate is lost or stolen, please immediately contact Jamie Lucas Images at 647-893-5263. A $20 replacement fee will apply. We will cancel the original certificate and issue a new one if the balance can be verified. 

4. Use of Gift Certificates

The gift certificate can only be used to pay for services and products offered by Jamie Lucas Images. The certificate is non-transferable and cannot be used for cash or refunded. Any remaining balance after a purchase will be available for future use as long as the certificate is valid.

You must present the gift certificate at the time of payment, either in person or online using the appropriate code. If the balance on the gift certificate is insufficient, you will be required to pay the remaining amount using an alternative payment method.

5. Payment and Transaction Terms

You authorize Jamie Lucas Images to deduct the appropriate amount from the balance of your gift certificate to cover the transaction amount, including taxes and fees. If a transaction occurs despite insufficient funds, creating a negative balance, you agree to reimburse Jamie Lucas Images for the overage.

6. Termination of Program

Jamie Lucas Images reserves the right to terminate the gift certificate program at any time, in which case all outstanding balances will be refunded.

7. Limitation of Liability

Jamie Lucas Images is not responsible for any delays or failures beyond our control, including issues with our systems or third-party services. In no event will Jamie Lucas Images be liable for indirect, consequential, or special damages. The maximum liability for any claims will be limited to the total amount paid for services under this agreement.

8. Website and Service Availability

While we strive to provide uninterrupted service, Jamie Lucas Images is not responsible for any website downtime or technical issues beyond our control. You agree not to interfere with or disrupt the website or engage in any illegal activities while using our website.

9. Entire Agreement

This Agreement represents the entire understanding between you and Jamie Lucas Images regarding the use of the gift certificate. Any amendments must be made in writing.
